These Terms of Service govern your use of Sumisketch ("Service"). By using the Service, you agree to these terms. Please read them carefully.

1. Service Description

Sumisketch is an art study tool for practicing drawing from reference images. The Service allows you to:

  • Upload reference images for timed practice sessions
  • Track your drawing practice over time
  • Generate share links to get feedback from others
  • Save your artwork alongside your references

2. Account & Eligibility

You must be at least 18 years old to use this Service. By accessing or using the Service, you represent and warrant that you are at least 18 years of age. By creating an account via Google OAuth, you agree to provide accurate information and maintain the security of your account. You are responsible for all activity under your account.

3. Content Moderation & Privacy

Please read this section carefully.

How Moderation Works

All uploaded images are automatically scanned for child sexual abuse material (CSAM). Additionally, images may be reviewed by our team if they are reported through share links or flagged by our systems. We reserve the right, in our sole discretion, to review any content on the platform to ensure compliance with these terms and applicable law.

Why We Moderate

We have a legal obligation to prevent the platform from being used to store or distribute illegal content, including child sexual abuse material (CSAM).

Consequences for Violations

  • Violating content will be removed
  • Your account may be suspended or terminated
  • We are legally required to report confirmed CSAM to the National Center for Missing & Exploited Children (NCMEC)
  • We may share relevant information with law enforcement

Your Privacy

Your reference images and artwork are stored privately and only accessible to you unless you choose to share them via share links.

4. AI and Data Use Policy

Generative AI Training

We do not use your artwork or uploaded images to train generative AI models. Your content is not sold, licensed, or used in any generative AI systems. Your reference images and artwork remain yours and are never fed into AI training datasets.

Research and Personalization

We may use anonymized or aggregated data derived from your usage patterns, practice sessions, and learning progress to:

  • Conduct research to better understand how people learn to draw and improve art education methods
  • Personalize your experience by tailoring practice recommendations, session timing, and content suggestions to optimize your learning
  • Improve the Service by analyzing aggregated learning patterns

This does not include your actual images or artwork—only anonymized statistics and usage data.

5. Your Content

Permitted Content

Reference images for art practice, your own artwork, and study materials.

Prohibited Content

  • Child sexual abuse material (CSAM) with zero tolerance, immediate termination and legal report
  • Content depicting minors in sexual or exploitative contexts
  • Malware or harmful files
  • Content intended to harass, threaten, or harm others

Reference Images & Copyright

Artists commonly use found images as references for study. Be thoughtful about what you share publicly via share links, as sharing redistributes the image. If a copyright holder submits a valid DMCA takedown request, we will remove the content (see Section 7).

Ownership

You retain ownership of your images and artwork. By uploading content, you grant us a limited, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, and create derivative works (such as thumbnails or previews) of your content solely as necessary to provide and improve the Service.

6. Share Links

When you generate a share link, the linked content becomes accessible to anyone with that link. Share links may expire; expiration times may vary based on your account type and system behavior. Shared content may be subject to moderation review.

7. Copyright & DMCA Takedowns

If you believe content on our platform infringes your copyright, you may submit a DMCA takedown request to contact@sumisketch.com including:

  • Identification of the copyrighted work
  • Identification of the infringing material and its location
  • Your contact information
  • A statement of good faith belief that the use is not authorized
  • A statement under penalty of perjury that your notice is accurate

Valid requests will be reviewed and infringing content removed. Repeat infringers will have their accounts terminated.

8. Reporting

If you encounter inappropriate content through a share link, report it using the report button. Reports are reviewed and investigated. False reports made in bad faith may result in account action.

9. Data Retention & Account Deletion

Your data is retained while your account is active.

Deleting Your Account

You may delete your account at any time through your account settings. Within 30 days of deletion:

  • All uploaded reference images will be permanently deleted
  • All saved artwork will be permanently deleted
  • Practice history and statistics will be permanently deleted
  • Active share links will stop working
  • This action is irreversible

We may retain anonymized logs for security, fraud prevention, and legal compliance, but nothing that identifies you or contains your content.

Your Stats & Analytics

We track your practice sessions, drawing times, streaks, and progress for display on your Stats page. We may use anonymized, aggregated data to improve the Service. Your images and artwork are never included in aggregate analytics.

10. Subscriptions & Payments

Paid subscriptions renew automatically until canceled. You may cancel anytime through your account settings; cancellation takes effect at the end of your current billing period. Purchases are non-refundable.

11. Termination

We may suspend or terminate your account for violations of these terms. If terminated for a violation, your content will be deleted. We may retain logs for legal compliance.

12. Disclaimers

The Service is provided "as is" without warranties of any kind. We do not guarantee uptime or data preservation. Maintain backups of important work. We are not liable for damages arising from use of the Service.

13. Changes to Terms

We may update these terms periodically. Significant changes will be communicated via email or in-app notification. Continued use after changes constitutes acceptance.

14. Disputes & Governing Law

These terms are governed by the laws of the State of California. If you have a dispute, please contact us first to attempt informal resolution. If we cannot resolve the issue, either party may pursue the matter in small claims court in the county where you reside, or in San Diego County, California.
